1. You are entitled to access the Internet through ELC Customer Premise Equipment (CPE) provided with the initial installation.  The Customer Premise Equipment includes the outside radio and brackets, inside POE equipment and transformer. This CPE equipment is and remains the property of ELC.   If it is determined that service to you is not sustainable ELC reserves the right to discontinue service and may refund a portion of prepaid services.

2. If your service has been installed less than a year, ELC at its discretion, may refund a portion of the install fee.

3. ELC provides services  for browsing the Internet websites and Web Email.  ELC does not guarantee a constant connection to the Internet for Business Critical Applications.  ELC does not guarantee connection to services such as AOL as they use proprietary connection methods which may terminate your connection. You may use this service, but it is not guaranteed.

4. ELC reserves the right to terminate services if you do not keep your virus and firewall protection updated or if your computer causes damage to other computers.

5. ELC reserves the right to terminate services at any time because of abusive language or excessive phone calls because of non guaranteed services.

6. ELC reserves the right to raise your monthly access fee or discontinue service fee if you consume than 2% of the total bandwidth of our services over a period of one week. This will not occur without a warning period which you can use to correct the situation. Turn off file sharing on your computer. If this continues, ELC may raise your basic monthly rate or cancel your services. 

7. The content of your web-storage data on your hard drive area is your responsibility. ELC prohibits the posting or sharing of any material stored on your computer. ELC prohibits posting and storage of data which is considered obscene, offensive or illegal in the United States. We reserve the right to cancel or refuse any service we feel does not represent the best interest of ELC’s clients or community goodwill. ELC will cooperate with State and Federal authorities on the prosecution of sharing of copyright material.

8. ELC reserves the right to refuse or discontinue service of any account holder engaging in activities which cause harm to individuals and or computers, making available materials which are offensive, copyrighted, or illegal, sending unsolicited email (junk email).

9. ELC prohibits the resale of Internet access and/or web storage areas. Personal accounts may not be used for commercial purposes of any kind. 

10. Misuse of electronic mail services is grounds for cancellation of services or deletion of your static mailbox. This misuse is defined by either leaving an extraordinary amount (more than 1 megabyte) of mail on our server, 'mail bombing' others with unsolicited email, or any activity which drains a disproportionate amount of our mail server's resources. 

11. Service is provided at the physical address of our CPE equipment and may not be retransmitted to any other address or location.  Any such retransmission will be considered theft. ELC will file charges for theft of services with the State of Texas Attorney General.

12. ELC Internet Services, Inc., reserves the right to terminate or refuse service to anyone, at any time, for any reason.

Your payment or acceptance of service is considered compliance and agreement with these policies.
